COVID-19 Employer Portal: A One Stop Hub for California Employers
CA Department of Labor & Workforce Development Agency

​The California Labor & Workforce Development Agency (LWDA) in coordination with CDPH recently launched a new Employer Portal, a one-stop hub for California employers to quickly find up-to-date state and local county COVID-19 guidance by business industry. The portal can be accessed at SaferAtWork.covid19.ca.gov, a new site for employers and workers featuring information about how we can all work together to prevent the spread of COVID-19 in the workplace.

SB-95 Employment: COVID-19: supplemental paid sick leave goes in effect 3.29.2021
​
SB 95 extends protections through September 30, 2021 and is retroactive to sick leave taken beginning January 1, 2021. Small businesses employing 25 or fewer workers are exempt from the legislation, but may offer supplemental paid sick leave and, if eligible, receive a federal tax credit.

CAL CHAMBER - COVID-19 Vaccine Guidance Released

On March 4, 2021, the California Department of Fair Employment and Housing (DFEH) updated its COVID-19 guidance, addressing several vaccination-related questions. The updated guidance replaces the version last updated on July 24, 2020.

The DFEH answers one of employers’ biggest questions — can they require employees to get vaccinated? Yes, says the DFEH, an employer may require employees to receive an FDA-approved vaccination so long as the employer complies with the Fair Employment and Housing Act (FEHA), meaning it “does not discriminate against or harass employees or job applicants on the basis of a protected characteristic, provides reasonable accommodations related to disability or sincerely-held religious beliefs or practices, and does not retaliate against anyone for engaging in protected activity (such as requesting a reasonable accommodation).”

AB 685

AB 685 is a new California law that requires employers to notify employees who may have been exposed to COVID-19 and to report workplace outbreaks of COVID-19 to the local health department.

Department of Homeland Security Guidance on the Essential Critical Infrastructure Workforce (CISA)

The Cybersecurity and Infrastructure Security Agency (CISA) executes the Secretary of Homeland Security’s authorities to secure critical infrastructure. Consistent with these authorities, CISA has developed, in collaboration with other federal agencies, State and local governments, and the private sector, an “Essential Critical Infrastructure Workforce” advisory list. This list is intended to help State, local, tribal and territorial officials as they work to protect their communities, while ensuring continuity of functions critical to public health and safety, as well as economic and national security. Decisions informed by this list should also take into consideration additional public health considerations based on the specific COVID-19-related concerns of particular jurisdictions. Latest EDD News
The federal CARES Act has added these provisions to expand unemployment benefits so we can help more Californians impacted by COVID-19:
  • Pandemic Unemployment Assistance – New program to provide unemployment benefits for people who don’t usually qualify for regular Unemployment Insurance.
  • Pandemic Emergency Unemployment Compensation – A 13-week benefit extension for people who have used all benefits available in their regular Unemployment Insurance claim.
  • Pandemic Additional Compensation – An additional $600 federal stimulus payment automatically added to each week of benefits received between March 29 and July 25, 2020.

COVID-19 Unemployment Benefit Guide 
Self-Employed
If you are self-employed, you may have benefits available from EDD employment insurance programs that you or your employer may have paid into over the past 5 to 18 months. You may have contributions from a prior job, or you could have been misclassified as an independent contractor instead of an employee. Apply for the benefit program that best fits your situation and include details about your employment to help us process your claim.

EDD - Disability Insurance (DI) Claim (if you have been sick or quarantined)

EDD - Pandemic Unemployment Assistance
Pandemic Unemployment Assistance (PUA) is one of the federal CARES Act provisions that helps unemployed Californians who are not usually eligible for regular Unemployment Insurance (UI) benefits. This includes business owners, self-employed workers, independent contractors, and those with a limited work history who are out of business or have significantly reduced their services as a direct result of the pandemic.  This program includes up to 46 weeks of benefits from February 2, 2020, through December 26, 2020, depending on when you were directly affected by COVID-19. PUA launched with up to 39 weeks of benefits and an extra seven weeks was recently added.

EDD - Paid Family Leave Claim: If you’re unable to work because you are caring for an ill or quarantined family member with COVID-19 (certified by a medical professional), you can file a Paid Family Leave (PFL) claim. PFL provides up to six weeks of benefit payments to eligible workers who have a full or partial loss of wages because they need time off work to care for a seriously ill family member or to bond with a new child. Benefit amounts are approximately 60-70 percent of wages (depending on income) and range from $50-$1,300 a week. If you are eligible, the EDD processes and issues payments within a few weeks of receiving a claim.

EDD- Unemployment Insurance (UI) Claim: File and manage your Unemployment Insurance (UI) Claim using UI Online 

EDD - Self Employed/Independent Contractor: The EDD offers an optional Disability Insurance Elective Coverage (DIEC) program for employers and self-employed individuals who are not required to pay into State Disability Insurance (SDI) but want to be covered by Disability Insurance (DI) and Paid Family Leave (PFL). DIEC is funded through quarterly premiums and can protect you against partial loss of income when you are unable to work.
